When Is the Right Time to Obtain a Restraining Order?

When you first decided to get into a committed relationship with your current partner, you probably never expected things to escalate and go downhill the way they have over the past few months. If your partner has been putting his or her hands on you during some of the arguments that the two of you have had, it is considered abuse. When the abuse first happened, you may have thought it would never happen again, but it may now continue to happen on a daily basis. Obtaining a restraining order is one of the best ways to get protection from an abusive partner. Even though you are considering it, you may not know when it is the right time to get one of these protective orders.

As soon as the incident happens, regardless of where you are at, make sure to go to your local police station. Do not remain in the same area with the abuser because then the problem may only get worse. In the event of an emergency, you will need to let the court clerk know that you need an ex parte order. The ex parte is an emergency restraining order given to people who are dealing with urgent situations and are unable to wait for the full one to go through. Even if you receive the ex parte order from the court clerk, you will still need to complete the domestic violence restraining order form. While you are filling out the form, you may need to provide the full name of your partner and the exact reason you need this type of protection against them too.

It is never too soon to fill out a form and get the protection you need against an abuser. If you wait around, things may get much worse. Even if you do not think it is that serious or that the person is not a serious threat to you, it is still better to play it safe than to end up dealing with a huge problem at any given moment. Nobody has the right to put their hands on you, whether you are in love with that person or not. You certainly do not deserve to be abused and have every right to seek protection in the form of a restraining order when you need it.
