Immigration Forms – The Waiting Period

All expats moving into the United States aspire to apply for citizenship or green card, however the wait period puts a big gap between their aspiration and achieving them in reality. Let us understand the processing times taken for various form as part of the Green Card Application Process, namely i485, i765, i130 and N400

Form i-485

The form i-485 is basically employment based adjustment application in the green card application process. The processing time for this form can differ from case to case. The main input that determines the duration is the category under which the green card application process has been filed. As part of processing, the step that consumes most of the time is the FBI name check. In spite of this the entire process can consume from at least 4 months to one year.

Form i-765

It was just last year when the U.S. council passed the rule that the spouses of any H1B expats who are already in the green card application process will be allowed to work. This rule was specifically called the H4 EAD. The work authorization for H1B spouses on H4 demands filing of the form i765. The processing time is quite quicker in comparison to other forms and is expected to be around 3 months. This duration may reduce further during the oncoming years.

Form i-130

This immigration form is filed as a petition for alien relative. This petition filing helps in establishing a familial relation between a U.S. citizen and a non U.S citizen. Once the application form with supporting document is received, the USCIS reviews the same. The review process may take several weeks or months or even years.

Form N-400

Naturalization is a process through which U.S. permanent residents can file for U.S citizenship. This is achieved through the filing of form n 400 with the USCIS. The processing time for N-400 is ideally four to seven months. However the time duration depends on when the review process is completed and the office to which the filling has been carried out.

Overall the green card application process is a process oriented task and the USCIS carries out every step in a very well refined manner. The complete green card application process may take anywhere from three years to ten plus years in obtaining the same. However it is important we show enough patience for the entire process to pull off for a longer stability in the Unites States.
