5 Ways to Tell You Need a Divorce Attorney

Nov 18th 2015 at 6:10 AM

Due to the time and cost involved with hiring lawyers, many couples are tempted to go through the divorce process on their own. That method actually works for a select group of individuals. As you begin the legal process of getting divorced, how will you know whether or not you will need to hire a divorce attorney?

One reason you will need a divorce attorney is if there are communication problems that cannot be resolved. Settling a divorce outside of court requires that the two people involved be able to talk, compromise and brainstorm all the effects and changes that come along with getting divorced. If the communication ends up going nowhere, or worse escalates the situation, it’s time to bring in some help.

Probably the number one factor in whether or not an attorney will be needed is how the decision making process goes. If the estranged couple is able to come to an agreement on most of the major decisions – custody, assets, finances – then there may not be a need for a lawyer. Unfortunately, most people seeking to dissolve their marriage are not that lucky and will need mediation or the services of an experienced divorce lawyer.

If there is a significant amount of property, money or other assets involved then it may be time to call and get assistance. Personal finances can be complicated and everyone wants to walk away with what they rightfully own. Laws exist to ensure that both parties are allowed to break this legal bond without needing to lose everything they possess.

Many marriages are partnerships where one individual controls all the finances. This leaves the other spouse clueless about debts, assets and other financial matters. It’s impossible to be certain that money and property will be divided evenly and fairly if someone is completely in the dark about what the couple’s financial status is.

If the situation has turned abuse, or has the potential to be violent, than hiring an attorney is necessary. Once the level of aggression has been heightened, people need a legal presence to help protect them and their assets. Having a third party work towards a resolution is better than facing the process alone. This is also true if there is concern that one of the parents in a divorce might be tempted to take the children and run. It’s imperative to get legal help right away if this situation exists!

If one or more of these scenarios is present in your divorce situation, it’s time to start looking for a qualified divorce attorney in Carmel.
